Sussex County Open Space Amendment

Cluster Subdivision Ordinance Amendment Ordinance ORD 26-04:
REGARDING HEIGHT, AREA AND BULK REQUIREMENTS of Sussex
County Code REGARDING OPEN SPACE, and Section 99 DEFINITIONS
REGARDING PUBLIC SITES and OPEN SPACES. Read Full Text.

Open space is a community resource, providing undisturbed natural features as well as passive and active recreational opportunities for community residents. In a broader context, it helps preserve natural resource features throughout the County, including wildlife habitat, wetland and forest preservation, and ecological functions vital to our quality of life.

SPC's Position On Amendment

The ordinance should be revised to include a better process for identifying and preserving important natural features during the development process

The ordinance should be revised to reduce unnecessary disturbance to areas to be set aside for open space during the development process

The ordinance should be revised to reduce forest loss by only allowing stormwater ponds to be considered open space if they were not created in forests and have natural features preserved
